Talaq-e-tafweez: column 18 in English
Column 18 of the Nikah Nama asks whether the husband has delegated the power of divorce to the wife. This is talaq-e-tafweez, the delegated right of divorce. Column 19 asks whether the husband's own right of divorce is limited in any way. Both are often struck out on the form, and a translation has to show exactly what the paper shows.
What the two columns say
- Column 18: "Whether the husband has delegated the power of divorce to the wife and, if so, under what conditions." کیا شوہر نے طلاق کا حق بیوی کو تفویض کیا ہے
- Column 19: "Whether the husband's right of divorce is in any way curtailed." کیا شوہر کے حق طلاق پر کوئی پابندی ہے
How to translate each case
| On the original | In the translation |
|---|---|
| ہاں written | Yes |
| ہاں، غیر مشروط written | Yes, unconditionally |
| Conditions written out | Yes, on the following conditions: [the conditions, translated] |
| نہیں written | No |
| Line drawn through the column | [Struck out in the original] |
| Nothing written | [Left blank in the original] |
Do not translate a struck-out column as "No". A caseworker comparing the translation with the original will see the line and the mismatch. Reports describe registrars crossing out this clause routinely (Brandsynario), so it is one of the most common places for a translation to differ from the paper.
This page explains how to translate the form. It is not legal or religious advice about divorce rights; for that, speak to a family lawyer.
Fastest fix: open NikahDraft, type what is written in each of the 25 columns, and it lays out the English translation in the form's own order, with mehr amounts in words and a translator's statement. The preview is free and runs in your browser; the clean PDF and Word file cost $9 once.
